McCanney said Jackson, when first interviewed by detectives, claimed he had not left his home at the time of the slaying. When Albany police arrived, the body cameras of Officer Bryce Allen captured the younger Wallace’s words identifying Jackson as his father’s attacker, according to McCanney and testimony from Allen, the prosecution’s first witness. Wallace's 11-year-old son did not allow Jackson back into the apartment when he arrived back for his glasses. She said footage also shows Brooks screaming at one point, “Call 911! Call 911!” She said the footage will corroborate the testimony of prosecution witnesses. McCanney told jurors that the doorbell camera, located outside a nearby residence, captured the comings and goings of all of the visitors to the crime scene, including Jackson. Jackson also ran out, then returned, asking outside the door for his glasses. Fifteen minutes after Wallace arrived home, just before 10 p.m., Jackson’s female friend and some of the children fled the apartment amid screams and commotion. Wallace slept briefly at the friend’s, then headed home. Wallace, while heavily intoxicated, left the apartment and stopped at the home of a friend. doesn’t keep playing, I’m gonna stab him.” Jackson later followed Brooks' brother into the kitchen and told the brother: “If T.Y. Wallace asked Brooks' brother to go shopping for dice so that Wallace and Jackson could gamble with it. The adults, including Brooks' brother, hung out and drank liquor in the living room. Jackson showed up again hours later, this time accompanied by a female friend and two children. The defendant stopped over to borrow money. Wallace, who was struggling with his use of alcohol, began drinking. On May 16, 2022, Wallace and Brooks kept their four young children home due to a forecast for severe thunderstorms and their lack of a car. On Tuesday, McCanney told jurors the sequence of events surrounding Wallace’s killing and Jackson’s arrest went as follows: His speciality was creating food with Caribbean and African flavor. While working as a sous chef at the Hollow, Wallace was a finalist for the Rising Star Chefs component of the annual Albany Chefs' Food & Wine Festival. Wallace, 32, a native of Detroit known as “T.Y,” worked in several Albany restaurants, including Yono’s, Olde English Pub and The Hollow Bar + Kitchen. Jackson has previously served state prison time for weapon possession, first-degree sexual abuse and failing to register as a sex offender, all since 2005. Jackson faces 25 years to life in prison if convicted of second-degree murder. “But Marquis Jackson is innocent of that death because he left the residence before that stabbing occurred… the evidence will show that Marquis Jackson had nothing to do with the death of Tyrome Wallace.” “Marquis Jackson got caught in the middle of a volatile relationship marked by domestic violence, marked by stressors that were placing incredible stress on the relationship between Martika and Tyrome - and those stressors caused an explosion that resulted in the death of Tyrome Wallace,” Berry told jurors. Jackson interfered to help Brooks, he said. Berry said Wallace and Brooks had an abusive relationship. Berry said Wallace's son told police, “Please don’t hurt my mother,” before identifying Jackson as the attacker.īerry said the boy’s words led Albany police to have “tunnel-vision” and to focus on Jackson while ignoring obvious evidence. Berry repeatedly cast suspicion on Wallace’s girlfriend, noting Brooks was covered in Wallace’s blood when police arrived. Timothy Berry, an alternative assistant public defender representing Jackson, told jurors in a nearly 20-minute opening statement that Jackson left the victim’s apartment before Wallace was killed. “This case is about a senseless act of violence,” McCanney told jurors. “Ask yourselves… when you’re hearing the evidence, what does that indicate to you? When someone is stabbing another person 14 times, what are they trying to do? What is their intent?” She said a medical examiner will testify that Wallace was stabbed 14 times, dying from internal bleeding and wounds that punctured Wallace’s lung and lacerated his liver. Both of them allegedly witnessed Jackson commit the slaying, McCanney told the jury. The prosecution’s witnesses include Brooks and her son, who was at 11 at the time of his father’s death.
